Many employed persons in Ontario are covered by disability insurance policies in the event they are injured or become seriously ill and cannot work. Most policies have certain criteria the injured worker must meet in order to qualify for the benefit. These normally are clearly stated in the disability policy manual or employee handbook. Typically, during the first 2 years of the disability, the test for the disability is whether or not you are able to perform the job you were doing at the time of sickness or injury. After two years, the test changes. You must show that you are unable to perform any job for which he/she is able to perform, taking into consideration education, experience and age. Often, Insurance companies will deny these benefits, despite evidence from treating physicians that you are, in fact, unable to return to work. Dangerous Premises (Slip & Fall) The term 'slip and fall' is a generic term used by lawyers to describe a fall that was caused by someone else's negligence. The fall can be a result of snow, ice or other slippery surface. It can also be a result of broken or uneven pavement, a wet floor or loose flooring or any other condition that makes the area dangerous. Injuries that result from these accidents may be a bruised or a scraped elbow. Or, they can be more serious injuries such as broken bones, torn ligaments and muscle damage, or even head Injuries.
